Returns and Exchanges Policy - ChefStarWear

At ChefStarWear, we want you to be completely satisfied with your purchase. If for any reason you are not happy with your order, we offer returns and exchanges according to the following policy, which is based on the laws of the Republic of Kazakhstan.

Right to Return or Exchange Goods of Satisfactory Quality

As a valued ChefStarWear customer, you have the right to return or exchange items of satisfactory quality if they are not suitable for you in terms of:

• Shape
• Size
• Color
• Dimensions
• Style
• Or Completeness

This means if you simply changed your mind, or the item isn't quite what you expected in these aspects, you can return or exchange it.

Conditions for Return or Exchange

To be eligible for a return or exchange, the following conditions must be met:

• The product MUST NOT have been used. It must be in its original, unused condition.
• The product MUST be in resalable condition. This means it needs to have all original packaging, tags, seals, and labels intact.
• Consumer properties MUST be preserved. The item should still function as intended and be suitable for resale.

Timeframe for Returns and Exchanges

• You can refuse the goods at any time before they are delivered to you.
• After you receive your order, you have 14 days to initiate a return or exchange.

Legal Basis for Our Policy

Our policy is based on the following articles from the Civil Code of the Republic of Kazakhstan (Special Part) and the Law of the Republic of Kazakhstan "On Protection of Consumer Rights":

Article 454 of the Civil Code - Exchange of Goods of Satisfactory Quality:

1. Within fourteen days from the date of receiving a non-food product (unless a longer period is announced by the seller), you may exchange the purchased ¹ goods at the place of purchase or other locations designated by the seller for a similar product of a different size, shape, dimensions, style, color, completeness, etc. If there is a price difference, a recalculation with the seller will be made.
2. If the seller does not have the necessary product for exchange, you have the right to return the purchased goods to the seller and receive a refund of the amount paid.
3. Your request for exchange or return will be satisfied if the goods have not been used, their consumer properties are preserved, and there is proof of purchase from this seller.
4. A list of goods that are not subject to exchange or return for the reasons specified in this article is determined by law.

Article 455 of the Civil Code - Rights of the Buyer in Case of Sale of Goods of Unsatisfactory Quality:

1. If you are sold goods of unsatisfactory quality (and the defects were not disclosed to you by the seller), you have rights as outlined in point 1 of Article 428 of this Code. You must return the unsatisfactory goods to the seller at their request and expense.
2. When refunding the money paid for the goods, the seller is not entitled to withhold an amount that reflects the reduced value of the goods due to full or partial use, loss of appearance, etc.

Article 428 of the Civil Code - Consequences of Transferring Goods of Unsatisfactory Quality:

1. If the defects were not disclosed by the seller, and you received goods of unsatisfactory quality, you may choose to demand from the seller:
   1. A proportionate reduction in the purchase price.
   2. Free repair of defects within a reasonable time.
   3. Reimbursement of your expenses for correcting the defects.
   4. Replacement of defective goods with goods that meet the contract.
   5. Cancellation of the contract and a refund of the money paid.

Article 14 of the Law "On Protection of Consumer Rights" - Consumer's Right to Exchange or Return Goods of Satisfactory Quality:

1. Within fourteen days from the date of receiving a non-food product (unless a longer period is announced by the seller), you may exchange the purchased goods for a similar product of a different size, shape, dimensions, style, color, completeness, etc. If there is a price difference, a recalculation with the seller will be made.
2. If the seller does not have the necessary product for exchange, you have the right to return the purchased goods to the seller and receive a refund of the amount paid.
3. The place of exchange or return is the place of purchase unless otherwise specified by contract.

Article 15 of the Law "On Protection of Consumer Rights" - Consumer's Right in Case of Sale of Goods of Unsatisfactory Quality:

1. If you are sold goods of unsatisfactory quality (and the defects were not disclosed to you), you have the right to demand, at your option:
   1. A proportionate reduction in the purchase price.
   2. Free repair of defects.
   3. Reimbursement of your expenses for correcting the defects.
   4. Replacement with goods of a similar brand (model, article).
   5. Replacement with the same goods of another brand (model, article) with a corresponding recalculation of the purchase price.
   6. Termination of the contract and refund of the money paid.

Article 30 of the Law "On Protection of Consumer Rights" - Obligations of the Seller in the Sale of Goods of Both Satisfactory and Unsatisfactory Quality:

1. The seller is obliged to ensure the exchange or return of non-food goods of satisfactory quality (if they have not been used and the conditions are met) within fourteen calendar days.
2. If defects are found and you request a replacement, the seller is obliged to replace it immediately, or within thirty calendar days if quality verification is needed.
3. With your consent, defects found in the goods must be eliminated by the seller within ten calendar days.
4. The seller is responsible for defects even if they were not known.
5. The seller is responsible for defects within the warranty period unless they prove the defects arose due to your misuse or storage, actions of third parties, or force majeure.
6. For each day of delay in fulfilling your requirements, the seller pays a penalty of one percent of the goods' value.
7. When refunding money, the seller cannot deduct for the diminished value of the goods due to use, loss of appearance, etc.
8. The seller must reimburse you for expenses related to the delivery and/or return of goods of unsatisfactory quality.
